APPLICANT REQUESTS THAT:

His Date of Birth (DOB) be changed in his Official Military 
Personnel Record from 15 May 35 to 15 May 38.


APPLICANT CONTENDS THAT:

He used the incorrect DOB to enter the Air Force.  He is now a 
proud 75 year old veteran on a fixed income and Veterans 
Benefits would be helpful to him.

STATEMENT OF FACTS:

The applicant initially entered the Regular Air Force on       
29 Apr 55.

On 29 May 59, the applicant was discharged with an honorable 
characterization of service and was credited with 3 years, 10 
months, and 22 days of active service.  

According to the DD Form 214, Armed Forces of the United States 
Report of Transfer or Discharge found in the applicant’s 
military personnel record, the applicant’s DOB is reflected as 
15 May 35.

AIR FORCE EVALUATION:

AFPC/DPSIRP recommends denial indicating there is no evidence of 
an error or an injustice.  In accordance with Air Force 
Instruction 36-3208, Military Personnel Records System, Table 
A7.5, Correction of Date of Birth, Note 3 states “Do not correct 
records of former members unless evidence proves the date of 
birth used while serving in the Air Force was erroneously 
recorded.”  A review of the applicant’s records revealed he 
enlisted, served, and was discharged under the DOB of “15 May 
35.”  As this was the DOB the applicant presented for enlistment 
and there was no change to his DOB during enlistment, it does 
not appear to have been erroneously recorded.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the 
applicant on 28 Jul 14 for review and comment within 30 days 
(Exhibit D).  As of this date, no response has been received by 
this office.


THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Sufficient relevant evidence has been presented to 
demonstrate the existence of an error or injustice.  We took 
notice of the applicant's complete submission in judging the 
merits of the case.  While we note the comments of the Air Force 
office of primary responsibility indicating that there was no 
evidence presented that the applicant’s date of birth was 
erroneously recorded, based on the documentation provided, we 
find it reasonable to conclude that the applicant, as with many 
in his generation, provided an incorrect date of birth so he 
could serve his country, even though he was too young to legally 
do so.  Given this, we believe it would be an injustice for the 
applicant to be deprived of benefits that his honorable service 
should bestow.    Therefore, we recommend the applicant's 
records be corrected as indicated below.	


THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air 
Force relating to the APPLICANT be corrected to show that his 
Date of Birth (DOB), as reflected in his military personnel 
records, be changed from 15 May 35 to read 15 May 38.
